Legal adviser
Legal advisers are qualified lawyers who give the organisation practical, accurate legal advice and help it manage legal risk. They draft and negotiate contracts, advise on data, procurement, employment, and health and care law, and manage disputes and claims. In a digital health care organisation much of their work is about technology: software licences, cloud and data processing agreements, data sharing, intellectual property in software and data, and the regulation of digital health products.

In a digital health care organisation
- Technology contracts must protect patient data, keep clinical services running, and make sure the organisation can leave a supplier safely.
- Using health data for direct care, planning, research, and AI raises questions under data protection law and the duty of confidentiality that need careful advice.
- Buying technology with public money must follow public procurement rules, and suppliers can challenge award decisions.
- The organisation may build software or data products, which raises questions of intellectual property, open source, and commercial use.
- Claims may involve harm to patients, including where digital services played a part, so advisers work with clinical safety, risk, and indemnity colleagues.
